Negotiations update from Mr. McMichael:
As you know, on September 27, the State appointed, neutral, third-party Factfinder ruled in favor Carmel Clay Schools and against the Carmel Clay Education Association. The Factfinder stated the CCEA’s Last Best Offer included unlawful provisions and it resulted in deficit financing, which is also unlawful.
In her decision, the Factfinder recommended to the Indiana Education Employment Relations Board that the Carmel Clay Schools’ Last Best Offer be implemented as the contract between the parties for the 2012-2013 school year.
We learned late last Friday that the Carmel Clay Education Association has appealed the Factfinder’s decision.
We are very disappointed CCEA took this action. The CCEA’s appeal will cause further delay in implementation of a contract, which in turn prevents us from providing salary and benefit increases to our teachers.
As you know, Factfinding initially was delayed for about a year because in the fall of 2012 CCEA filed an unfair labor practice and got a stay of the Factfinding proceedings.
After a hearing, both the Hearing Officer determined the CCEA’s charge of an unfair labor practice was without merit and ruled in favor of the district. The CCEA then filed an appeal of the Hearing Officer’s ruling and, after further delay, the Indiana Education Employment Relations Board also ruled in favor of the Carmel Clay School District.
The stay was then lifted and Factfinding resumed.
As I said at Factfinding, the State appointed, neutral, third-party Factfinder ruled in favor of the Carmel Clay School District and against CCEA. Now CCEA has filed an appeal of the Factfinder’s decision. We feel badly for our teachers because the CCEA’s appeal likely will further delay our ability to implement a contract and provide our teachers with salary and benefit increases.
The team working on this on behalf of the Carmel Clay School District will do everything we can to expedite the process so we can provide salary and benefit increases to our teachers as soon as possible.
